These terms apply to bloomcreates.ca (the “site”), operated by Bloom Creative (“we”, “us”), a sole proprietorship operated by Noah Morris, 9 John Martin Cres, Millgrove, ON L8B 0Z9, Canada. By using the site, you agree to them. If you do not agree, please do not use the site.

1Our services and prices

  • The site describes our services and prices. Prices are shown in Canadian dollars, or in US dollars for visitors in the United States, and do not include applicable taxes.
  • Prices, plans, offers and descriptions on the site may change at any time. Showing them is not an offer that you can accept to form a contract.
  • We provide services only under a written agreement between you and us. If anything on the site differs from that agreement, the agreement applies. Timeframes and commitments described on the site explain how we work; the ones that apply to you are those in your agreement.

2Booking a call and your free first draft

  • Booking a call is free and does not commit you to anything. Bookings are made through Cal.com, whose terms apply to its booking tool.
  • Before the call we may prepare a first draft of a website for your business from publicly available information, such as your website and Google Business Profile. The draft is free and creates no obligation.
  • The draft, including its design, code and wording, remains our property. You may view it on the call, but you may not copy, publish or otherwise use it, or have anyone else build from it, unless you become a client. If you do not go ahead, we delete it after 90 days.
  • Your business’s own name, logo, photos and content remain yours. We use them only to prepare the draft.
  • Sales calls are recorded and transcribed for our notes, as our privacy policy explains.

3The guide and other content

  • The site and its content, including its text, design, graphics, videos, code and the guide “What’s leaking work out of your shop, and how to stop it.” (on the web and as a PDF), belong to us or to those who license them to us, and are protected by copyright and other laws.
  • You may share the guide freely, on the web or as its PDF, as long as it is unchanged and credited to Bloom Creative. You may forward it, print it and link to it. You may not edit it, sell it, include it in a paid product, or present it as your own.
  • Otherwise you may view and print pages of the site for your own business use. Any other use needs our written permission.
  • Some photographs on the site are licensed stock images. Their rights belong to their owners.

4Using the site

You agree not to:

  • use the site for anything unlawful;
  • try to disrupt or overload the site, or to gain unauthorised access to it or to any system behind it;
  • copy or collect the site’s content at scale with automated tools, other than search engines that follow our robots.txt file;
  • make false or misleading bookings, or impersonate anyone.

5Information on the site

The site gives general information about running a shop and about our services. It is not legal, tax, financial or other professional advice. Where we cite research by others, we name the source, but we are not responsible for its accuracy. We do not promise any particular result, such as a number of calls, enquiries, reviews or search rankings.

7No warranties

The site is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind about the site, including that it will be available without interruption or free of errors, or that its content is complete or current.

8Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of the site. Our total liability for any claim relating to the site is limited to CA$100. Nothing in these terms limits any liability that cannot be limited by law. Your use of our services is governed by your agreement with us.

9Privacy

Our privacy policy explains how we handle personal information.

10Changes

We may change the site and these terms at any time. Changes take effect when they are posted here with a new date.

11Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute about the site, unless the law where you live gives you the right to bring a claim there.

12General

If any part of these terms is found unenforceable, the rest remains in effect. If we do not enforce a term, we have not waived it.
